    Without question, Avalon is one of the best beach towns on the South Jersey coast. Jutting a mile further out in the Atlantic than other shore points, its cool ocean breezes and pristine beaches make for a fantastic family vacation.

    That is, unless you happen to cross the Avalon Beach Patrol, who seem to relish acting like storm-troopers.

    A case earlier this month illustrates just how out-of-control the Beach Patrol --- and by extension, Avalon itself--- has become.

    As is the case with most shore towns, beach tags are required. This policy has long irked the vast majority of beach-goers, who believe they more than pay the cost of beach preservation by the many taxes and fees levied on them.  And they also believe, not unjustifiably, that the beach belongs to everyone, and no one should have to pay to use it.

    Disdain aside, most comply.  Incredibly, though, that wasn’t good enough for the Avalon Patrol.

    Most days, beach tag inspectors guard the entrances to beaches, checking to ensure that beachgoers have tags.

    On a recent weekend, a woman with three young children --- including one with a broken arm --- was entering the beach. Asked for her tags, she informed the 14-year old inspector that her husband had them on the loaded beach cart. He was 50 feet behind her, in clear view. The woman’s two youngest then sprinted to an open spot near the life-guard stand, where they always set up camp for the day.

    No problem, since the woman and her husband had seasonal tags --- just as they had for the past 11 years.

    Or so it seemed.

    As the husband approached, he showed his tag, and started onto the beach.  The checker asked if he was with “that other woman.” Having no clue to what she was referring, he inquired what she meant. After discerning it was his wife, he showed the second tag (children under 12 do not need tags).

    He had no issue showing the beach tags at the entry point, but stated his frustration over continually getting harassed throughout the day by teams of roving tag inspectors. These teams work the beaches, routinely awakening people, interrupting conversations and even demanding swimmers leave the water to show tags (many people have their tags affixed to bags or chairs.)

    The point the man was making was simple.   Logic dictates that if tags are inspected upon entry, then inspectors walking the beaches aren’t necessary.

    At that point, the inspector snapped, “That’s enough out of you.  Keep quiet. I don’t want to hear another word.” 

    This, from a 14 year old girl!

    That attitude should be grounds for dismissal for any employee, but for a minor to speak to an adult in that manner is utterly unacceptable. This fresh-mouthed child was completely out of line as a representative of Avalon.

    The man asked who she thought she was to speak to anyone like that, whereupon she made a beeline to the lifeguard stand and reported that someone actually had the “gall” to speak back to her.

    Within minutes, four guards showed up in trucks, and began interrogating the husband and wife, while Little Miss Personality was high-fiving one of the lifeguards.

    The Lieutenant --- yes, they take that army title way too seriously --- then proceeded to demand answers from the man, asking, “Do you think it was right to talk to a 14-year old girl like that?  That’s harassment!”

    The man replied that the Lieutenant had not been there, took the word of one of his own as gospel, and didn’t even ask what had actually occurred.  So much for due process.

    At this point, the Lieutenant’s “backup” --- a Captain, and obviously the real brains of the group --- stated that he could have the man “arrested for harassment.”

    How so?  Because the husband had his arms folded while he was talking.  This, he was told, “…was harassment.  It’s a defensive posture, and I know about these things, because I deal with bad people like you all the time.”

    How’s that for incoherence?

    The end result was that the wife was issued a citation for $80.  The “crime?”  Failure to have beach tags.

    Even though she had a seasonal tag.

    Go figure.

    And the icing on the cake?  The husband asked for the names of each Beach Patrol member as well as the 14-year old girl, but was told by the Lieutenant, “No.  You don’t need that information. I am the issuing ‘officer.’  That’s all you need.”

    Interesting that he could issue the citation at all, since he wasn’t even there when the woman met the beach inspector.  That’s like getting a speeding ticket from an officer who didn’t pull you over for the violation.

    The woman took off a morning of work to fight the ticket, arriving at Avalon Court at 9:00 am, yet after two hours, she was told her case wouldn’t be heard until the afternoon.  With a two-hour drive ahead of her, and a morning of lost productivity behind her, she reluctantly decided that principle would have to fall victim to practicality, and paid the citation.

    Several questions come to mind:

    1) If one doesn’t have a beach tag while on the beach, standard procedure is for inspectors to sell them a tag. How then is it possible to EVER issue an $80 citation to someone not having a tag?  Do you fine black people but not whites?  College kids but not “well-to-do” older folks?  Where do they draw the line?

    There is nothing worse --- and more dangerous --- than selective enforcement.

    2) What ever happened to the “customer being right?” Avalon would be nothing without the people who patronize businesses, buy and rent houses, and recommend the town to friends.  So how could the town’s “bread and butter” be treated so poorly?

    And as proof that this wasn’t an isolated event, there were at least five other incidents with this particular beach-brat inspector that day, including one woman who had to give her pocketbook to the inspector as collateral while she fetched her tag on her chair.

    Avalon, like most governments, has laws and regulations on the books that make darn near everything a violation.

    Games on the beach?  Can’t do it.  Throw a ball in the ocean?  Nope.  Have a gas grill on your deck?  Don’t even think about it.

    All against the law, but virtually never enforced. 

    Government should never have ordinances which are selectively enforced.

    This breeds contempt for the system and leads to widespread abuse by overzealous wannabes on a power-trip.

    There are many good things about Avalon, but, as is always the case, they are overshadowed by the bad.  The city fathers would be wise to eliminate all but the necessary ordinances, and start remembering who makes the town what it is.

    The forgotten taxpayer.

    Author’s Note: I have NEVER been one to use the media pulpit for personal reasons, which is why I chose not to reveal that it was Yours Truly who was involved in Beachtag-gate, and why I waited until AFTER the court date to write about an issue to which so many relate.  In the weeks since the event, I have been (anecdotally) swamped by similar tales from Avalon patrons.     On a recent weekday at Annunciation B.V.M. Church in Havertown, a Mass was celebrated to pray for and honor police officers --- both those on the front lines and those who have fallen in the line of duty.

    It was an emotional service, especially given the number of police who have been brutally slain in the last several years.  The thought of a lonely and distraught spouse raising young children --- including some unborn who never even glimpsed their father--- was so heartbreaking as to be unthinkable.

    The worst part is that there’s no rational way to explain, let alone overcome, the absolute senselessness of why these officers were slain.
    Where is our country headed when cops are being killed with abandon? 

    While all innocent human life is sacred, there is something different about shooting a law enforcement officer. It breaks down the last barrier of respect, and it violates the code that most criminals follow - you don't take shots at police. Period.

    Like anything else in life, once that taboo is broken, all bets are off.  In Philadelphia's case, it is now obvious that cops are fair game. The breakdown of the city is virtually complete.

    With civility and respect quickly becoming a faded memory, further imperiling our children’s future, people are increasingly asking what, if anything, can be done to reverse this deadly course.

    The answer is simple.  It’s just not easy:

    School choice.

    We have just witnessed the murder trial of cop-killers Eric Floyd and Levon Warner.  Both owners of long rap sheets, they heinously gunned down Officer Stephen Liczbinski in 2008. These animals deserve the death penalty, plain and simple, but that doesn’t answer how you stop such an atrocity from occurring in the future.

    If you’re looking to politicians for help, you’ll be blind before that happens.

    Every time there’s another crime in the headlines, Mayor Michael Nutter spews the same monotonous babble that the violence epidemic will be curtailed.

    But nothing has changed. In fact, despite all the resources put into fighting crime, it's only getting worse.

    Whether its flash mobs, citizens getting gunned down, brutal subway attacks ---or cops in the crosshairs, it’s clear that respect for authority is non-existent, and no one is off-limits to the predators.

    Philadelphia’s murder, violence and homeless rates are among the highest in the nation, and there’s absolutely nothing to indicate that the situation will improve anytime soon, if ever.

    Three things have become readily apparent:

    1) The way we did things in the past hasn't worked.

    2) What we're doing now isn't having an impact.

    3) Unless a bold leader takes steps to institute true reform and eschew band-aid solutions to gaping wounds, the city ---and the region ---will continue its plummet into the abyss.

    Here's the part no one wants to admit. There is NO short-term solution.

    We can talk all day about fairy-tale feel-good “solutions” by invoking vague rhetoric: community partnerships, town watches, more police, and of course, the ultimate panacea, banning guns.

    But since we've been hearing that for decades, ad nauseum, here's a newsflash to our leaders: none of these things work. And they're not going to, either, because they are tactics without the benefit of a strategy.

    Enter school choice.

    The dire situation in which we find ourselves boils down to our horrendously bad educational system, and, as a direct result, the lack of hope in our young people.

    With no possibility of receiving a quality education, and the prospects for a decent job virtually nonexistent, many of our youth see the dream of a stable and prosperous life as nothing more than an illusion. Faith is lost.

    At that point, when people feel they have nothing to live for, or to lose, they resort to risk-taking criminal activity. The end result is despair, fear, violence and murder.

    Even though our public schools are in shambles, and many are deathtraps for student and teacher alike, most parents have no options.
    When education is trumped by survival, everybody loses.

    So why doesn't the system change?

    Greed.

    Greed to keep the status quo the way it is because it immensely benefits a narrow few. And greed to keep the truth out of sight, buried behind 30 second sound bites.

    And the greediest offender of all?  The teachers’ unions.

    The unions are terrified of school choice because it would inject competition into our schools, which would 
    expose incompetence, and the masses will finally see that the system's failure has nothing to do with a lack of money.

    But since so many of our politicians, especially in Philadelphia, are in bed with these unions, school choice programs continue to be thwarted.

    Without a doubt, the union leadership wields immense political power because it reaps millions in forced union dues, which are used for partisan political purposes. But how long can we --- and our “leaders” --- be held hostage to them?

    Break the stranglehold of the unions, and you break the violence, both in our schools and our city.

    When parents have a choice in their children's education, schools that perform will attract more students and succeed, and those that continue with the status quo will lose students and fail. The free market system that has served us so well will have the same effect on our educational product.

    For the first time in generations, school choice will allow our students to actually learn the skills necessary to succeed in life.

    Because of a quality education, they will have hope for a better tomorrow, understanding that it is better to live in a stable environment than be part of a criminal world in which the lifespan is shorter than those in third-world nations.

    Criminals today don't fear the crossfire because they feel they have nothing to live for anyway. Until that mentality is changed, Philadelphians will continue to be held hostage, and more people - including children and police officers - will die.

    But instead of action on choice, all we hear are empty promises.

    To Mayor Nutter, Gov. Rendell, much of the state legislature and the union leadership who have perpetuated this senseless violence because of their deliberate failure to act, shame on you.

    We can only hope that the next Governor and a new legislature will have the political will to do the right thing.

    If not, how much more blood will be spilled?

  • Christopher Freind Roger Clemens Steroid Hearing Is A Joke Written by Christopher Freind

    Here we go again.

    Congress is conducting yet another circus, this time looking into allegations of steroid use by baseball superstar Roger Clemens.

    The star witness against Clemens is his former trainer, Brian McNamee, who has two spectacular claims:

    1. He injected Clemens with Human Growth Hormone (HGH) and steroids, and

    2. He saved bloody needles that he used on Clemens.

    Shall we analyze each?

    Let's start with the second, just because it's more fun. The items in question would be used for DNA analysis and to determine the presence of steroids and HGH. Sounds reasonable enough until the second part of the equation is brought to light.

    The needles are seven years old. Seven years!

    I don't normally tune into CSI, but I have to believe that over the better part of a decade, such "evidence" might become a bit contaminated.

    There isn't a court in the country that would allow these needles (and some bloody gauze) to be admitted as evidence. So why the charade?

    Of course, there is also that little thing we call the law that seems to escape most on Capitol Hill and in the media. Let's assume McNamee did in fact inject Clemens with steroids in 2000. So what? Not only would Clemens not have committed any crime, but here's the ultimate kicker: He wouldn't even have broken baseball's rules.

    Consumption of any drug - cocaine, heroin, steroids - is not illegal. Period. There is no gray area. It is the manufacture, distribution and possession of such substances that are against the law. You want to prove Clemens "supplied" the steroids? Good luck. About the only thing more difficult to prove is perjury.

    The most mystifying aspect of the "steroids era" is why the media continues to drop the ball on informing the public when baseball outlawed steroids. Most fans will tell you "the mid-90s." Not even close. Try 2005.

    Now that's what I call being on top of things, Commissioner Selig!

    Selig and Major League Baseball rode to glory during the steroid era, and now, hypocritically, they pass the buck and feign innocence.

    Instead of getting tough on the present players, they would rather generate headlines by destroying the names, accomplishments and legacies of baseball's best with not a shred of evidence backing up their claims. That's pathetic.

    Unlike Selig, Freindly Fire does back up its charges. All we hear from Selig is how MLB is getting "tough" on steroid use. How tough? Just ask Mike Cameron. He's the Gold Glove outfielder who just signed a $7 million contract with the Milwaukee Brewers (ironically, the team Selig owned throughout the steroid era) - but he has to sit out a paltry 25 games at the beginning of this season because he tested positive for a banned substance --- for the second time!

    What punishment do they give you for the first offense? A bonus?

    Why is Selig allowed to remain commissioner? And where was Congress' tough questioning during Selig's testimony last month?

    So let's get this straight. It's OK to demonize players and stigmatize their families with no evidence, but more importantly, it's OK to do nothing about solving the steroid problem.

    Only in America.

    Lip service, empty promises and hypocrisy. Maybe Bud Selig should run for Congress.

The “Jack Murtha” Philadelphia Navy Shipyard? Just Say NO!

Reports have surfaced that Pennsylvania Democrats are in favor of naming the iconic Philadelphia Navy Shipyard after the recently-deceased Congressman Jack Murtha.

I have just one question for those who favor of such a preposterous idea---such as Congressman Bob Brady and Philadelphia City Councilman Jim Kenney:

“Hi.  I’m Earth.  Have we met?”

On what planet are these people living?

Yes, naming the venerable shipyard ---one that played a decisive role in the Allies’ victory in World War II --- after a man who flagrantly disregarded that old document called The Constitution for his own political benefit seems like a swell idea.

A Vietnam veteran, Murtha knew firsthand how difficult fighting could be on both the battlefield and homefront.  One would think a war as controversial as Vietnam, in which soldiers became targets of venomous slurs and unfair accusations by the public and elected officials, would have taught Big Jack the lessons of patience, humility and honor.

One would be wrong.

Murtha was one of the leading critics of the Iraq War, advocating a complete withdrawal.  Fine.  We should have no problem with that, as America is still (nominally) a free country, and Murtha is entitled to his opinion.

But he inexcusably crossed the line when he accused U.S. Marines of war crimes, referring to them as “murderers” engaged in “cold blooded” killing after an incident in the Iraqi town of Haditha.

Making the sin mortal was that Jack didn’t care about due process, completely ignoring the “innocent until proven guilty” tenet we hold so sacred in this country. 

Last time I checked, you don’t give up your rights as an American when you put on a military uniform.  In fact, you deserve those protections more than ever.

In addition to accusing those Marines of such a heinous crime, Murtha also stated that the military was complicit in the murder, stating, “There has to have been a cover-up. … There's no question about it.”

During a national television interview, Murtha stated that he would, “not excuse murder and that what's happened.”  This, of course, was well before the investigation was completed, let alone the courts-martial that exonerated them.

Well Jack, I’ve got news for you and your still-living morally-corrupt cronies:

We are not going to let the stellar reputation of the Philadelphia Navy Shipyard be disgraced with your nefarious name.

More important, we aren’t going to excuse you for your unforgivable behavior, which hopefully hasn’t caused an American soldier to die because he hesitated about defending himself in the face of brutal enemy fire.

If that be the case, you’d better run to God for protection from the Marines you might meet in Heaven --- assuming you ever get there.
